Understanding Child Custody Laws in Virginia
Virginia courts must formally establish both legal custody and physical custody in every case. Legal custody governs a parent’s authority to make decisions about the child’s healthcare, education, and upbringing. Physical custody governs where the child lives and the time each parent spends with the child. Courts can award joint legal custody, joint physical custody, sole custody, or a combination, depending on what the statutory best-interests analysis supports.
While parents are presumed to be the best custodians of their child, third parties such as grandparents may seek custody when specific circumstances warrant. To prevail, a third party must prove by clear and convincing evidence that one or more of the following circumstances exist:
