How Military Retirement Pay Is Divided in Virginia

The Uniformed Services Former Spouses’ Protection Act (USFSPA) is the federal law that authorizes state courts to treat a servicemember’s retired pay as marital property. In Virginia, an equitable distribution state under Code Section 20-107.3, retirement pay earned during the marriage is subject to division. The amount actually divisible is the disposable retired pay, which excludes VA disability compensation, military disability retired pay, Survivor Benefit Plan (SBP) premiums, and any court-martial forfeitures.

Two rules shape how that division is structured and paid:

• The 10/10 rule: Defense Finance and Accounting Service (DFAS) can pay a former spouse directly only if the marriage lasted at least 10 years, overlapping at least 10 years of creditable military service. Below that threshold, retirement can still be divided, but the servicemember must transfer the required amount directly.
• The frozen benefit rule: Following a 2016 federal amendment, Virginia courts value the marital share of retirement based on the member’s rank and years of service at the time of divorce, not at eventual retirement. This prevents a former spouse from receiving the benefit of promotions earned after the marriage ends.

Courts can also order SBP coverage so a former spouse can continue to receive survivor income if the servicemember dies before or after retirement begins.

Custody, Deployment & Child Support for Military Families

Virginia courts apply the same best-interests-of-the-child standard in military divorces as in civilian cases. What differs is the planning required. Deployment orders and potential relocation can make standard parenting schedules unworkable, so parenting plans often need contingency provisions built in from the start.

Service members who have sole custody, or who share custody with a parent they aren’t married to, are required by the military to maintain a Family Care Plan designating a caregiver during deployment or any period of unavailability. That document intersects directly with what a Virginia custody order can require. Child and spousal support in military divorces follows Virginia’s standard guidelines, but calculations factor in base pay, allowances, and deployment history, all of which require careful documentation.

Filing a Military Divorce in Virginia: Jurisdiction & SCRA Protections

Virginia requires at least six months of residency before a divorce petition can be filed. For military members, time stationed in Virginia counts toward that requirement, even during deployment. A servicemember stationed here, including aboard a ship ported in the state, satisfies residency the same way a civilian would.

If an active-duty spouse is deployed or otherwise unable to participate, the Servicemembers Civil Relief Act (SCRA) allows them to request a stay of at least 90 days in divorce proceedings. This protection exists so a deployed servicemember isn’t defaulted against while serving. Virginia recognizes both fault-based and no-fault grounds for divorce, and separation periods used to establish no-fault grounds can include time the servicemember spent deployed.
