Virginia Same-Sex Divorce: The Legal Framework

The U.S. Supreme Court’s 2015 decision in Obergefell v. Hodges established the constitutional right to marriage for same-sex couples and, with it, equal rights and obligations in divorce. Virginia recognizes same-sex marriages performed in other states, so couples who married elsewhere can file for divorce in Virginia as long as they meet the residency requirement: At least one spouse must have been a bona fide Virginia resident for at least six months before filing (Va. Code § 20-97). The divorce may be filed in the county where either party currently resides or where the parties last cohabitated.

Same-sex divorce cases in Frederick County are filed with the Frederick County Circuit Court. While the legal process is identical to any other Virginia divorce, LGBTQ couples can face distinct questions about property acquired before marriage was legally available, how courts treat the legal marriage duration versus the actual relationship length, and parental rights when non-biological parents are involved.

Virginia permits both no-fault and fault-based divorce. The no-fault path, available to any couple regardless of sexual orientation or gender identity under Va. Code § 20-91, requires a period of separation before filing.

Property Division: Equitable Distribution & Pre-Marriage Cohabitation

Virginia is an equitable distribution state. Marital property is divided fairly based on the circumstances of the marriage, not automatically split 50/50. Only marital property, generally property acquired during the marriage, is subject to division. Assets acquired before the legal marriage are typically classified as separate property.

This creates a significant issue for many same-sex couples. Partners who lived together and functioned as economic partners for years or decades before same-sex marriage became legally available often find that courts start the marital estate from the date of legal marriage. Property, pensions, and retirement accounts accumulated during years of committed partnership prior to legalization may fall outside the marital estate under that framework. The date a Virginia court treats as the start of the marriage can meaningfully affect property division.

Child Custody & Parental Rights in Same-Sex Divorces

Virginia custody law applies a best-interests-of-the-child standard (Va. Code § 20-124.3) in all divorce cases. In Frederick County, the Circuit Court handles custody matters within a divorce proceeding; standalone custody cases go to the Juvenile and Domestic Relations District Court.

In many same-sex marriages, only one spouse is the biological parent of a child. A non-biological parent who hasn’t legally adopted the child may face significant challenges asserting custody or visitation rights under Virginia law. Formal adoption by the non-biological parent establishes equal legal parentage and removes ambiguity. Parental rights questions can also arise from assisted reproduction arrangements, where the legal standing of each parent may depend on the terms of those agreements and whether formal legal steps were completed.

Spousal Support in Virginia Same-Sex Divorces

Virginia courts may award spousal support in same-sex divorces on the same statutory basis as any other divorce. Factors the court weighs include each spouse’s income and assets, the standard of living during the marriage, the length of the marriage, each spouse’s ability to be self-supporting, and contributions made to the other spouse’s education or career.

For same-sex couples, the length of the legal marriage may be considerably shorter than the actual economic partnership. That gap can affect both the amount and duration of any support award. Spousal support ends when the recipient remarries or begins habitually cohabitating with another person in a relationship analogous to marriage for one year or more.
